Administrative Measures for the Acceptance of Civil Explosives Construction Projects

  Article 1 In order to ensure the safety of the production of civilian explosives (hereinafter referred to as civil explosives) and to regulate the acceptance of civil explosives construction projects, according to the Regulations on the Safety Management of Civil Explosives, the Implementation Measures for the Safety Production of Civil Explosives and the Relevant National Regulations , formulate these measures.

  Article 2 The acceptance of civil explosives construction projects referred to in these Measures refers to the on-site verification of the safety production licenses and sales license projects for civilian explosives. These measures shall apply to enterprises that apply for safety production licenses, sales licenses, or re-apply for licenses due to major changes in the safety conditions of the original licenses, and organize experts to conduct on-site inspections.

  Article 3 The State strictly implements the safe production conditions for civil explosive construction projects. For projects that fail to pass the inspection, the administrative departments of civil explosives at all levels shall not give safety production licenses or sales licenses.

  The Ministry of Industry and Information Technology is responsible for the acceptance of new construction, reconstruction and expansion of production lines and on-site mixed operation equipment and facilities construction projects for the adjustment of the production capacity and variety of civil explosives.

  The administrative department in charge of the province, autonomous region, and municipality directly under the Central Government (hereinafter referred to as the provincial civil explosion industry administrative department) shall be responsible for the local technical transformation and major equipment renewal of the original production line without increasing production capacity and without changing the product variety. The acceptance of new construction, reconstruction and expansion of storage facilities construction projects.

  The provincial civil explosion industry administrative department is responsible for the assessment of the production safety conditions of the production line and the on-site mixed operation construction project and the approval of the trial production plan, and reports the trial production plan to the Ministry of Industry and Information Technology for the record. The trial production time is generally no more than 6 months, and the pilot production plan should be 10-20% of the licensed production.

  Article 4 The State implements an annual reporting system for the progress of the construction project of civil explosives production lines. The project construction unit reports the progress of the project to the Ministry of Industry and Information Technology every year. The project construction period should generally not exceed two years.

  The preliminary design of the civil explosive construction project can be reviewed by the enterprise to hire experts, or the enterprise can be submitted to the competent government department to organize experts for review. The results are for enterprise reference.

  Article 5 The trial production of production lines and on-site mixed operation construction projects shall meet the following basic requirements for safe production conditions:

  (1) It has complete technical procedures, safety operation procedures (including quotas for quantification, destruction procedures), product inspection procedures and other technical documents and enterprise standards.

  (2) The enterprise shall organize the internal inspection and acceptance of the production line.

  (3) The enterprise shall formulate a trial production plan and complete the training of relevant operators.

  (4) Other conditions that the assessment unit of the safe production conditions considers necessary.

  Article 6 The acceptance of civil explosive construction projects shall meet the following conditions:

  (1) Advanced process technology and equipment shall be adopted; the adopted process technology shall have the certificate of scientific and technological appraisal or technical achievement acceptance organized by the competent department of civil explosion industry, and shall not adopt the production process technology that is eliminated and restricted by the state; The equipment shall comply with the relevant regulations on the management of special production equipment for civil explosives.

  (2) It shall comply with the laws, standards and policies of the state and industry regarding environmental protection, energy conservation and product quality.

  (3) The design of the production line and on-site mixed operation construction project shall be undertaken by the design unit with the Class A qualification of civil explosive equipment approved by the Ministry of Industry and Information Technology; the design of the enterprise storage facility construction project shall be provided with the civil explosive equipment of Class B or above. The unit with qualifications (including Grade B) is responsible.

  (4) The production facilities have reached normal operation through trial operation. The number of continuous trial production products has reached more than 5% of the annual design capacity or the continuous production has reached more than 20 batches; the safety performance and performance of the type-tested products meet the standard requirements;

  (5) The problems raised in the safety evaluation report have been rectified and confirmed by the original safety appraisal agency.The security measures in the design document have been implemented.

  Article 7 In addition to the necessary information for the application for safe production license, the following information shall be provided for the acceptance of the project:

  (1) A permit for civilian explosives;

  (ii) Complete design information and drawings. The production line and on-site mixed operation construction project shall include the location map, external distance map, general plane and vertical layout diagram, process flow chart, process equipment floor plan, construction, fire protection, lightning protection and other drawings of the production line; storage facilities construction project It should include drawings such as external distance maps, general floor plans, buildings, fire protection, and lightning protection.

  (3) Buildings, fire protection, lightning protection, environmental protection and occupational health facilities shall be tested by professional institutions or passed the inspection documents of local competent authorities.

  (4) The safety appraisal report issued by the appraisal agency and the confirmation certificate of the rectification and implementation, and the certificate of implementation of the safety measures issued by the design unit.

  (5) The production line construction project shall also provide product process regulations, safety operation procedures (including quotas for quantification, destruction procedures), product inspection procedures, emergency rescue plans, and batch trial production summary reports. Includes self-examination and acceptance, corporate standards, economic analysis, technical analysis, quality analysis, standardization review reports and user comments. A product quality test conformity report issued by the civil explosive testing agency;

  (6) Organizing the inspection and acceptance unit requires other information provided by the enterprise.

  Article 8 The specific procedures for the acceptance of civil explosive construction projects:

  (1) In accordance with Article 7 of these Measures, the enterprise shall submit the application materials for the safety production license and the materials required for the acceptance of the construction project to the administrative department of civil explosion industry at the provincial level where the operation site is located.

  (2) According to the division of duties of Article 3, the units that organize the acceptance of construction projects shall, within 5 working days after receiving the application materials for acceptance, handle them separately according to the circumstances: if the application materials are incomplete, notify the applicants to supplement them at one time, overdue. If it is not informed, it shall be accepted as of the date of receipt of the application materials; if the conditions for acceptance are not met, the decision not to accept the inspection shall be made; if it is determined that it is not necessary to organize the on-site inspection by the experts, the safety production license shall be directly handled in accordance with relevant regulations. , sales license; to meet the acceptance conditions, after review to determine the need to organize experts on-site verification, the decision to agree to the acceptance of the notification to inform the applicant, and timely organize experts to verify on-site.

  (3) The organization accepting and accepting units shall, according to the nature and content of the acceptance items, establish an acceptance expert group and convene an on-site acceptance meeting. The expert group shall select more than 5 experts from the national civil explosion industry expert database. Due to special professional needs, experts from other civil explosion industry experts may be employed to participate. The leader of the expert group shall be a member of the National Civil Explosives Industry Expert Committee.

  (4) The acceptance expert group shall listen to the application unit's report, survey the site, review the acceptance data, confirm the true reliability of the data, test the product quality, conduct necessary inquiry and review, and form the opinion of the expert group. The opinions of the expert group shall be signed by all experts of the acceptance expert group.

  (5) After the construction project has passed the inspection and acceptance, the organization accepting and accepting units shall review the acceptance conclusions and make timely treatment according to the situation: if the conditions for acceptance are met, the “Certificate of Acceptance of Civil Explosives Construction Projects” (see annex) shall be approved; the conditions for acceptance shall not be met. The application unit shall be notified in writing; for the items that can pass the acceptance after rectification, the contents of the rectification shall be notified in writing and reviewed, and after the rectification conditions are determined, the “Certificate of Acceptance of Civil Explosives Construction Project” shall be approved.

  Article 9 These Measures shall be interpreted by the Ministry of Industry and Information Technology.

  Article 10 These Measures shall come into force on January 1, 2010. On February 6, 2007, the Measures for the Administration of Acceptance of Civil Explosives Construction Projects issued by the former Commission of Science, Technology and Industry for National Defense were simultaneously abolished.

 ItisunderstoodthatthetopofthehillgardenislocatedinthesouthsideofZhongshanCollege,DongchengDistrict,ZhongshanCity,ZhongshanCity,ontheeastsideofthesnowroad,willbebuiltintheStarCityBuilding. Thebuildingtobeexplodedis104.1meters,withatotalof34floors(including1basement),33.8meterswidefromeasttowest,38.5meterslongfromnorthtosouth,and27875squaremeters. Thebuildingisframe-supportedshearwallstructure,arrangedina“well”shape.The1stfloorandthebasementareframestructures,the2-32floorsareshearwallstructures,andthemiddlepartisthecoretube. Theeastsideofthebuildingis44metersawayfromthebottomoftheslope,thesoutheastsideis40metersawayfromDongyueTemple;thesouthsideis5.2metersawayfromthewall,only6metersawayfromthenearestresidentialhouse;thewestsideis81metersawayfromthebottomoftheslope. Thebuildingwasbuiltin1994andwascappedin1997. Forvariousreasons,thebuildinghasnotbeenofficiallyputintouse.IthasbeenrenamedasthePeakGarden,YangmingMountainVilla,StarCity,andZhongshanCity,butithasneverbeenabletogetridofthefateofthe"unfinished". InJune2007,thebuildingwastransferredtoZhongshanChangjiangZhaoyeRealEstateDevelopmentCo.,Ltd.asawhole. InordertocopewiththeoverallplanningdevelopmentofZhongshanCity,acceleratethepaceofrenovationoftheoldcity,andaccordingtothecompany'sprojectplanningneeds,decidedtouseblastingdemolition,theplotwillberebuiltafterthedemolition.   OnFebruary25,commissionedbythePublicSecurityBureauoftheMinistryofPublicSecurity,theGuangdongProvincialPublicSecurityDepartmentandtheZhongshanPublicSecurityBureau,theChinaEngineeringBlastingAssociationhostedareviewmeetinginBeijingonthe“BlastingDemolitionProjectoftheUnfinishedBuildingoftheShijiazhuangPeakGardeninZhongshanCity”.TheexpertgroupledbyWangXuguang,academicianoftheChineseAcademyofEngineeringandchairmanoftheChinaEngineeringBlastingAssociation,listenedtothebriefingandreviewrequirementsoftheProvincialPublicSecurityDepartmentandtheMunicipalPublicSecurityBureauontheblastingproject,andintroducedtheconstructionplanoftheGuangdongZhongrenGroup.Afterquestioninganddiscussion,thereviewopinionswereputforwardandtheMunicipalPublicSecurityBureauwasapprovedtoapprovetheconstructionoftheproject. Inordertoensurethesafetyandsuccessoftheblastingdemolitionproject,theZhongshanMunicipalGovernmenthasspeciallysetupacoordinationheadquarters,whichisresponsiblefort
