 Thecompetentdepartmentsofnationaldefensescienceandtechnologyindustry,publicsecurityorgans,andadministrativedepartmentsforindustryandcommerceshall,inaccordancewiththeirdivisionofresponsibilities,beresponsiblefororganizinginvestigationsintotheillegalproduction,sale,purchase,storage,transportation,mailing,anduseofcivilianexplosives.   Article5Themainpersoninchargeoftheproduction,sale,purchase,transportationandblastingofcivilexplosives(hereinafterreferredtoasthecivilexplosivesbusinessunit)isthepersonresponsibleforthesafetymanagementofcivilexplosivesinthisunit,andthesafetymanagementofcivilexplosivesinthisunit.Fullyresponsible.   Thecivilexplosivesunitsarethekeyunitsforpublicsecuritywork.Theyshouldsetuppublicsecurityagenciesorpublicsecuritypersonnelaccordingtolaw,andsetuptechnicalpreventionfacilitiestopreventtheloss,theftandlootingofcivilianexplosives.   Thecivilexplosivesunitsshallestablishasafetymanagementsystemandapostsafetyresponsibilitysystem,formulatesafetyprecautionsandaccidentemergencyplans,andsetupsafetymanagementagenciesorstaffwithfull-timesafetymanagementpersonnel.  Article8Anyunitorindividualhastherighttoreportviolationsoftheregulationsonthesafetymanagementofcivilianexplosives;thecompetentdepartmentorpublicsecurityorganthatreceivesthereportshallimmediatelyinvestigateanddealwithit,andkeepthereportconfidentialandproviderewardstothosewhoreportmeritoriousservice.   The "Regulations on the Safety Management of Civil Explosives" was adopted at the 134th executive meeting of the State Council on April 26, 2006. It is hereby promulgated and will be implemented as of September 1, 2006.

Regulations on the Safety Management of Civil Explosives

 

Chapter I General Provisions

 

  Article 1 These Regulations are formulated in order to strengthen the safety management of civilian explosives, prevent explosions, and protect citizens' lives, property safety and public safety.

 

  Article 2 These Regulations apply to the production, sale, purchase, import and export, transportation, blasting operations and storage of civil explosives and the sale and purchase of ammonium nitrate.

 

  The term "civil explosives" as used in these Regulations refers to all kinds of gunpowder, explosives and their products, and detonators and fuses for ignition and detonation equipment used for non-military purposes.

 

  The list of civilian explosive articles shall be formulated and promulgated by the competent department of national defense science and technology industry of the State Council in conjunction with the public security department of the State Council.

 

  Article 3 The State implements a licensing system for the production, sale, purchase, transportation and blasting of civilian explosives.

 

  Without permission, no unit or individual may produce, sell, purchase or transport civilian explosives, and shall not engage in blasting operations.

 

  It is strictly forbidden to transfer, lend, lend, mortgage, give away, privately possess or illegally hold civilian explosives.

 

  Article 4 The competent department of national defense science and technology industry shall be responsible for the safety supervision and management of the production and sale of civilian explosives.

 

  The public security organs are responsible for the public safety management of civilian explosives and the safety supervision and management of the purchase, transportation and blasting operations of civilian explosives, and monitoring the flow of civilian explosives.

 

  The competent departments of production safety supervision, railways, transportation, and civil aviation shall be responsible for the safety supervision and administration of civil explosives in accordance with the provisions of laws and administrative regulations.

 

  The competent departments of national defense science and technology industry, public security organs, and administrative departments for industry and commerce shall, in accordance with their division of responsibilities, be responsible for organizing investigations into the illegal production, sale, purchase, storage, transportation, mailing, and use of civilian explosives.

 

  Article 5 The main person in charge of the production, sale, purchase, transportation and blasting of civil explosives (hereinafter referred to as the civil explosives business unit) is the person responsible for the safety management of civil explosives in this unit, and the safety management of civil explosives in this unit. Fully responsible.

 

  The civil explosives units are the key units for public security work. They should set up public security agencies or public security personnel according to law, and set up technical prevention facilities to prevent the loss, theft and looting of civilian explosives.

 

  The civil explosives units shall establish a safety management system and a post safety responsibility system, formulate safety precautions and accident emergency plans, and set up safety management agencies or staff with full-time safety management personnel.

 

  Article 6 Persons without civil capacity, persons with limited capacity for civil conduct or those who have been criminally punished for crimes shall not engage in the production, sale, purchase, transportation and blasting of civilian explosives.

 

  The units for civil explosives shall strengthen the safety education, legal education and post technical training for the employees of the unit. Only those who have passed the examination shall be allowed to work on the job; those with qualifications shall be equipped with the corresponding qualified personnel.

 

  Article 7 The State establishes an information management system for civilian explosives, implements label management for civilian explosives, and monitors the flow of civilian explosives.

 

  The civil explosives production enterprises, sales enterprises and blasting operation units shall establish a civil explosives registration system, and truthfully input the varieties, quantities and flow information of the civil explosives produced, sold, purchased, transported, stored and used by the unit into the computer system.

 

  Article 8 Any unit or individual has the right to report violations of the regulations on the safety management of civilian explosives; the competent department or public security organ that receives the report shall immediately investigate and deal with it, and keep the report confidential and provide rewards to those who report meritorious service.

 

  Article 9 The State encourages civil explosives practitioners to adopt new technologies to improve the safety performance of civilian explosives and encourage the development of a business model integrating the production, distribution and blasting of civilian explosives.

 

Chapter II Production

 

  Article 10 The establishment of a civilian explosives production enterprise shall follow the principle of overall planning and rational distribution.

 

  Article 11 An enterprise applying for the production of civilian explosives shall meet the following conditions:

 

  (1) In line with national industrial structure planning and industrial technology standards;

 

  (2) The design, structure, building materials, safety distance and safety equipment and facilities such as fire protection, explosion protection, lightning protection and anti-static of factory buildings and special warehouses comply with relevant national standards and norms;

 

  (3) The production equipment and processes conform to the technical standards and regulations related to safety production;

 

  (4) Having qualified professional and technical personnel, safety production management personnel and production post personnel;

 

  (5) having a sound safety management system and a post security responsibility system;

 

  (6) Other conditions stipulated by laws and administrative regulations.

 

  Article 12 An enterprise that applies for the production of civilian explosives shall submit an application form, a feasibility study report and relevant materials capable of proving that it meets the conditions stipulated in Article 11 of these Regulations. The competent department of national defense science and technology industry of the State Council shall conduct a review within 45 days from the date of accepting the application. If the conditions are met, the "production permit for civilian explosives" shall be issued; for those who do not meet the conditions, the "production permit for civilian explosives" shall not be issued. , explain the reasons to the applicant in writing.

 

 

 

  In order to rebuild or expand the production capacity and variety of civil explosives production enterprises, they shall apply for the "Civil Explosives Production License" in accordance with the provisions of the preceding paragraph.

 

  Article 13 An enterprise that has obtained the "Permit for the Production of Civil Explosives" shall, after the completion of the capital construction, apply to the competent department of national defense science and technology industry of the State Council for a safe production license. The competent department of national defense science and technology industry of the State Council shall conduct inspections in accordance with the provisions of the Regulations on Safe Production Licenses. If the conditions meet the requirements, the safety production license shall be marked on the “Civil Explosives Production License”. A civilian explosives production enterprise may produce civil explosives only after it has gone through the industrial and commercial registration with the industrial and commercial administrative department with the production permit for civil explosives.

 

 

 

  The civil explosives production enterprise shall, within 3 days after handling the industrial and commercial registration, file with the public security organ of the local county-level people's government.

 

  Article 14 The civilian explosives production enterprises shall strictly carry out the production according to the varieties and output approved by the "Civil Explosives Production License", and the production operations shall strictly follow the provisions of the safety technical regulations.

 

  Article 15 A civilian explosives production enterprise shall make warning signs and registration marks for civilian explosives and code the detonators. The warning signs, registration marks and detonator coding rules for civil explosives shall be prescribed by the public security department of the State Council in conjunction with the State Council department in charge of national defense science and technology.

 

  Article 16 A civilian explosives production enterprise shall establish and improve a product inspection system to ensure that the quality of civilian explosive articles conforms to relevant standards. The packaging of civil explosives shall comply with the provisions of laws and administrative regulations and relevant standards.

 

  Article 17 The test or trial production of civilian explosives must be carried out in a special site or in a special laboratory. It is strictly forbidden to test or test civilian explosives in production workshops or warehouses.

 

Chapter III Sales and Purchase

 

  Article 18 An enterprise applying for the sale of civilian explosives shall meet the following conditions:

 

  (1) meeting the requirements for the planning of the enterprise for the sale of civilian explosives;

 

  (2) The sales place and the special warehouse comply with relevant national standards and norms;

 

  (3) Having qualified management personnel and warehouse management personnel;

 

  (4) having a sound safety management system and a post security responsibility system;

 

  (5) Other conditions stipulated by laws and administrative regulations.

 

  Article 19 An enterprise applying for the sale of civilian explosives shall submit an application form, a feasibility study report and a certificate capable of proving that it meets the requirements of Article 18 of the Regulations to the competent department of national defense science and technology industry of the local province, autonomous region or municipality directly under the Central Government. Related materials. The competent department of national defense science and technology industry of the people's government of a province, autonomous region or municipality directly under the Central Government shall conduct a review within 30 days from the date of accepting the application, and conduct inspections on the operating facilities of the applicant's sales place and special warehouses, and issue "civil explosive articles for the eligible conditions." Sales License: For those who do not meet the requirements, the "Civil Explosives Sales License" will not be issued, and the reasons will be explained in writing to the applicant.

 

  A civilian explosives sales enterprise may sell civilian explosives only after it has gone through the "commercial explosives sales license" to the industrial and commercial administrative department for industrial and commercial registration.

 

  The commercial explosives sales enterprise shall, within 3 days after the industrial and commercial registration is completed, file with the public security organ of the local county-level people's government.

 

  Article 20 A civilian explosives production enterprise may, according to the "Civil Explosives Production License", sell the civilian explosives produced by the enterprise.

 

  The civil explosives production enterprises shall not exceed the approved varieties and output for the sale of civilian explosives produced by the enterprise.

 

  Article 21 If a unit for the use of civilian explosives applies for the purchase of civilian explosives, it shall submit an application for purchase to the public security organ of the local county-level people's government, and submit the following relevant materials:

 

  (1) Industrial and commercial business license or corporate legal person certificate;

 

  (2) "Blasting Operation Unit Permit" or other proof of legal use;

 

  (3) The name, address and bank account of the purchaser;

 

  (4) Description of the variety, quantity and use of the purchase.

 

  The public security organ accepting the application shall examine the submitted materials within 5 days from the date of accepting the application, and issue the "Civil Explosives Purchase Permit" if it meets the requirements; if it does not meet the conditions, it shall not issue the "Civil Explosives". Purchase License, explain the reasons in writing to the applicant.

 

  The "Civil Explosives Purchase License" shall specify the variety, quantity, purchase unit and validity period of the license.

 

  Article 22 A civilian explosives production enterprise purchases the raw materials belonging to civilian explosives with the "Civil Explosives Production License", and the civilian explosives sales enterprises purchase civilian explosives from the civilian explosives production enterprises with the "Civil Explosives Sales License". Articles, units used by civilian explosives to purchase civilian explosives under the "Public Explosives Purchase License" shall also provide the identity certificate of the manager.

  Enterprises that sell civilian explosives shall examine the licenses and the identity certificates of the operators as stipulated in the preceding paragraph; and purchases for the "Civil Explosives Purchase License" shall be sold in accordance with the varieties and quantities permitted.

  Article 23 The sale and purchase of civilian explosives shall be conducted through bank accounts and may not be traded in cash or in kind.

  Enterprises that sell civilian explosives shall keep a copy of the purchaser’s license, bank account transfer voucher, and the identity certificate of the manager for 2 years.

 

  Article 24 An enterprise that sells civilian explosives shall, within 3 days from the date of sale and purchase of civilian explosives, send the varieties, quantities and purchase units sold to the competent department of defense science and technology industry of the local provinces, autonomous regions and municipalities directly under the Central Government. The public security organs of the people's government at the county level shall record the case.

 

  Units that purchase civilian explosives shall, within 3 days from the date of sale and purchase of civilian explosives, file the purchased varieties and quantities with the public security organs of the local people's government at the local level.

 

  Article 25 The import and export of civilian explosives shall be examined and approved by the competent department of national defense science and technology industry under the State Council. The examination and approval measures for the import and export of civilian explosives shall be stipulated by the competent department of national defense science and technology industry of the State Council in conjunction with the public security department of the State Council and the General Administration of Customs.

 

  The import and export unit shall record the variety and quantity of civilian explosives for import and export to the public security organ of the county-level people's government at the place of receipt or exit.

 

Chapter IV Transportation

 

  Article 26 For the transport of civilian explosives, the receiving unit shall submit an application to the public security organ of the county-level people's government of Yundadi, and submit materials including the following contents:

 

  (1) "Civil Explosives Production License", "Civil Explosives Sales License", "Civil Explosives Purchase License" or import and export provided by civilian explosives production enterprises, sales enterprises, users and importers and exporters respectively. Proof of approval;

 

  (2) The variety, quantity, packaging materials and packaging methods of transporting civilian explosives;

 

  (3) The characteristics of transporting civilian explosives and emergency disposal methods for dangerous situations;

 

  (4) Transportation time, starting point, transportation route, and stopping place.

 

  The public security organ accepting the application shall examine the submitted materials within 3 days from the date of accepting the application, and issue the "Civil Explosives Transport Permit" if it meets the requirements; if it does not meet the conditions, it shall not issue the "Civil Explosives". Transport Permit, explain the reasons in writing to the applicant.

 

  The "Civil Explosives Transport License" shall specify the receiving unit, the sales enterprise, the carrier, the one-time transport expiration date, the starting point, the transport route, the stopover point, and the variety and quantity of civilian explosives.

 

  Article 27 The transportation of civilian explosives shall be carried out in accordance with the permitted varieties and quantities in accordance with the "Civil Explosives Transport License".

 

  Article 28 The following provisions shall be observed when transporting civilian explosives by road:

 

  (1) Carrying the "Transportation Permit for Civil Explosives";

 

  (2) The loading of civilian explosives conforms to relevant national standards and norms, and no manned persons are allowed in the carriage;

 

  (3)The safety technical status of the transport vehicle shall comply with the requirements of the relevant national safety technical standards, and shall hang or install warning signs of inflammable and explosive dangerous articles in accordance with national standards in accordance with regulations;

 

  (4) Vehicles transporting civilian explosives shall maintain a safe speed;

 

  (5) Driving in accordance with the prescribed route, there shall be special guards on the way, and away from the building facilities and densely populated areas, and shall not stop at places other than the permit;

Chapter V Blasting Operations

 

  Article 31 Units applying for blasting operations shall meet the following conditions:

 

  (1) The blasting operation is a legal production activity;

 

  (2) There is a special warehouse for civilian explosives that conforms to relevant national standards and norms;

 

  (3) Having safety management personnel, warehouse management personnel and blasting operations personnel with qualifications prescribed by the state;

  (4) having a sound safety management system and a post security responsibility system;

 

  (5) There are special equipment for blasting operations that meet national standards and industry standards;

 

  (6) Other conditions stipulated by laws and administrative regulations.

 

  Article 32 Units applying for blasting operations shall, in accordance with the provisions of the public security department of the State Council, submit an application to the public security organ of the relevant people's government and provide relevant materials capable of proving that they meet the conditions stipulated in Article 31 of these Regulations. The public security organ accepting the application shall conduct the examination within 20 days from the date of accepting the application, and issue the "Blasting Operation Unit Permit" if it meets the requirements; if it does not meet the conditions, it shall not issue the "Blasting Operation Unit Permit", written to The applicant explains the reasons.

  Article 39 When a blasting operation unit no longer uses civilian explosives, it shall register the remaining civilian explosives and report them to the public security organ of the local people's government at the local level for supervision and destruction.

Chapter VI Storage

  Article 40 Civil explosives shall be stored in a special warehouse and technical prevention facilities shall be set up in accordance with state regulations.

 

  Article 41 The following provisions shall be observed for the storage of civilian explosives:

 

  (1) Establishing an inspection and registration system for warehousing, and collecting and distributing civilian explosives must be registered so that the accounts are clear and the accounts are consistent;

 

  (2) The quantity of stored civilian explosives shall not exceed the storage design capacity, and civilian explosives that are incompatible with the nature must be stored in separate warehouses. It is strictly forbidden to store other items in the warehouse;

  Article 43 If a civilian explosive article fails and expires, it shall be promptly cleared out of the warehouse and destroyed. Chapter VII Legal Liability

  Article 46 Anyone who violates the provisions of these Regulations and has one of the following circumstances shall be ordered by the public security organ to make corrections within a time limit, and shall be imposed a fine of not less than 50,000 yuan but not more than 200,000 yuan; if it is not corrected within the time limit, it shall be ordered to suspend production and suspend business for rectification:

  (2) purchasing civilian explosives in excess of the variety and quantity of the purchase license;

 

 

  (3) using cash or in kind for the trading of civilian explosives;

 

  (4) failing to keep a copy of the purchaser's license, bank account transfer voucher, and the identity certificate of the manager in accordance with the regulations;

 

  (5) Selling, purchasing, importing and exporting civilian explosives, and failing to file with the public security organ in accordance with regulations;

 

  (6) failing to establish a registration system for civilian explosives in accordance with the regulations, and truthfully inputting the varieties, quantities and flow information of civilian explosives produced, sold, purchased, transported, stored and used by the unit into the computer system;

 

  (7) Failure to return the "Civil Explosives Transport License" to the issuing authority for verification.

 

  Article 47 Anyone who violates the provisions of these Regulations and transports civilian explosives through the road in any of the following circumstances shall be ordered by the public security organ to make corrections and shall be fined not less than 50,000 yuan but not more than 200,000 yuan:

 

  (1) Violation of the transportation permit;

 

  (2) failing to carry the "Civil Explosives Transport License";

 

  (3) mixing civil explosives in violation of relevant standards and norms;

 

  (4) The transport vehicle fails to hang or install the warning signs of inflammable and explosive dangerous goods in accordance with national standards;

 

  (5) Failure to follow the prescribed route, without stopping by a special person or stopping at a place other than the permit;

 

  (6) carrying passenger compartments of civilian explosives;

 

  (7) If the dangerous situation occurs, the necessary emergency measures shall not be taken immediately and reported to the local public security organ.

 

  Article 48 In case of violation of the provisions of these Regulations, if the unit engaged in blasting operations has any of the following circumstances, the public security organ shall order it to stop the illegal act or correct it within a time limit, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if it is overdue, it shall not be corrected. Order to suspend production and suspend business for rectification; if the circumstances are serious, revoke the "Blasting Operation Unit Permit":

 

  (1) The blasting operation unit has not engaged in blasting operations in accordance with its qualification level;

 

  (2) The commercial blasting operation unit carries out blasting operations across administrative areas of provinces, autonomous regions and municipalities directly under the Central Government, and fails to report in advance to the public security organs of the people's governments at the county level where the blasting operation is located;

 

  (3) The blasting operation unit fails to establish a registration system for the collection of civilian explosives in accordance with the regulations, and saves the registration record;

 

  (4) Performing blasting operations in violation of relevant national standards and norms.

 

  If a blasting operation personnel violates the relevant national standards and norms and implements blasting operations, the public security organ shall order it to make corrections within a time limit. If the circumstances are serious, the blasting operation personnel permit shall be revoked

  Article 50 In case of violation of the provisions of these Regulations, if the civil explosives employer has one of the following circumstances, the public security organ shall impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if the circumstances are serious, the license shall be revoked; To give public security management penalties according to law:

 

  (1) Violating the safety management system, causing civilian explosives to be lost, stolen or robbed;

  Article 53.  ItisunderstoodthatthetopofthehillgardenislocatedinthesouthsideofZhongshanCollege,DongchengDistrict,ZhongshanCity,ZhongshanCity,ontheeastsideofthesnowroad,willbebuiltintheStarCityBuilding. Thebuildingtobeexplodedis104.1meters,withatotalof34floors(including1basement),33.8meterswidefromeasttowest,38.5meterslongfromnorthtosouth,and27875squaremeters. Thebuildingisframe-supportedshearwallstructure,arrangedina“well”shape.The1stfloorandthebasementareframestructures,the2-32floorsareshearwallstructures,andthemiddlepartisthecoretube. Theeastsideofthebuildingis44metersawayfromthebottomoftheslope,thesoutheastsideis40metersawayfromDongyueTemple;thesouthsideis5.2metersawayfromthewall,only6metersawayfromthenearestresidentialhouse;thewestsideis81metersawayfromthebottomoftheslope. Thebuildingwasbuiltin1994andwascappedin1997. Forvariousreasons,thebuildinghasnotbeenofficiallyputintouse.IthasbeenrenamedasthePeakGarden,YangmingMountainVilla,StarCity,andZhongshanCity,butithasneverbeenabletogetridofthefateofthe"unfinished". InJune2007,thebuildingwastransferredtoZhongshanChangjiangZhaoyeRealEstateDevelopmentCo.,Ltd.asawhole. InordertocopewiththeoverallplanningdevelopmentofZhongshanCity,acceleratethepaceofrenovationoftheoldcity,andaccordingtothecompany'sprojectplanningneeds,decidedtouseblastingdemolition,theplotwillberebuiltafterthedemolition.   OnFebruary25,commissionedbythePublicSecurityBureauoftheMinistryofPublicSecurity,theGuangdongProvincialPublicSecurityDepartmentandtheZhongshanPublicSecurityBureau,theChinaEngineeringBlastingAssociationhostedareviewmeetinginBeijingonthe“BlastingDemolitionProjectoftheUnfinishedBuildingoftheShijiazhuangPeakGardeninZhongshanCity”.TheexpertgroupledbyWangXuguang,academicianoftheChineseAcademyofEngineeringandchairmanoftheChinaEngineeringBlastingAssociation,listenedtothebriefingandreviewrequirementsoftheProvincialPublicSecurityDepartmentandtheMunicipalPublicSecurityBureauontheblastingproject,andintroducedtheconstructionplanoftheGuangdongZhongrenGroup.Afterquestioninganddiscussion,thereviewopinionswereputforwardandtheMunicipalPublicSecurityBureauwasapprovedtoapprovetheconstructionoftheproject. Inordertoensurethesafetyandsuccessoftheblastingdemolitionproject,theZhongshanMunicipalGovernmenthasspeciallysetupacoordinationheadquarters,whichisresponsiblefort
