  Chapter I General Provisions

 

  Article 1 This Law is enacted for the purpose of strengthening safety production supervision and management, preventing and reducing production safety accidents, safeguarding the lives and property of the people, and promoting economic development.

 

  Article 2 This Law shall apply to the safe production of units engaged in production and business activities (hereinafter collectively referred to as production and business units) within the territory of the People's Republic of China; relevant laws and administrative regulations shall be applicable to fire safety and road traffic safety, railway traffic safety, and water traffic safety. If there are other provisions on the safety of civil aviation, the provisions shall apply.

 

  Article 3: Safety production management shall adhere to the principle of safety first and prevention first.

 

  Article 4 Production and business units must abide by this Law and other laws and regulations concerning safety production, strengthen safety production management, establish and improve a safety production responsibility system, improve safety production conditions, and ensure safe production.

 

  Article 5 The principal person in charge of a production and business unit shall be fully responsible for the safety production work of the unit.

 

  Article 6 The employees of production and business units shall have the right to obtain safety production guarantees according to law, and shall fulfill their obligations in safety production according to law.

 

  Article 7 Trade unions shall organize employees to participate in the democratic management and democratic supervision of the safety production work of their own units, and safeguard the legitimate rights and interests of employees in safety production.

 

  Article 8 The State Council and local people's governments at all levels shall strengthen their leadership over work in safety production, and support and urge all relevant departments to perform their duties of supervision and management of production safety in accordance with the law.

 

  The people's governments at or above the county level shall coordinate and solve major problems in the supervision and management of production safety in a timely manner.

 

  Article 9 The department in charge of safety production supervision and administration of the State Council shall, in accordance with this Law, implement comprehensive supervision and management of national safety production work; the departments responsible for safety production supervision and administration of local people's governments at or above the county level shall, in accordance with this Law, produce safety in their respective administrative areas.   Article 10 The relevant departments of the State Council shall, in accordance with the requirements for ensuring safe production, promptly formulate relevant national standards or industry standards in accordance with the law, and make timely revisions in accordance with scientific and technological progress and economic development.

 

 

 

  Production and business units must implement national or industrial standards that are guaranteed by law to ensure safe production.

 

 

 

  Article 11 The people's governments at all levels and their relevant departments shall adopt various forms to strengthen the publicity of laws, regulations and production safety knowledge related to safe production, and raise the awareness of workers' safety in production.

 

 

 

  Article 12 Intermediary institutions established in accordance with law to provide technical services for safe production shall, in accordance with laws, administrative regulations and practice standards, accept the entrustment of the production and operation units to provide technical services for their safe production.

 

 

 

  Article 13 The State shall implement a system for investigating the responsibility for production safety accidents and, in accordance with the provisions of this Law and relevant laws and regulations, investigate the legal responsibility of those responsible for production safety accidents.

 

 

 

  Article 14 The State encourages and supports the promotion and application of safety production science and technology research and advanced technologies for safe production to improve the level of safe production.

 

 

 

  Article 15 The State shall award incentives to units and individuals that have made outstanding achievements in improving safety production conditions, preventing production safety accidents, and participating in rescue and rescue operations.

 

 

 

  Chapter II Safety Production Guarantee of Production and Business Units

 

 

 

  Article 16 A production and business operation unit shall have the safe production conditions stipulated in this Law and relevant laws, administrative regulations and national standards or industry standards; if it does not have the conditions for safe production, it shall not engage in production and business activities.

 

 

 

  Article 17 The principal person in charge of a production and business unit shall have the following duties for the safety production of the unit:

 

 

 

  (1) Establishing and improving the safety production responsibility system of the unit;

 

 

 

  (2) Organizing the formulation of the safety production rules and regulations and operating procedures of the unit;

 

 

 

  (3) Ensuring the effective implementation of the safety production investment of the unit;

 

 

 

  (4) Supervising and inspecting the safety production work of the unit and eliminating hidden dangers of production safety accidents in a timely manner;

 

 

 

  (5) Organizing the formulation and implementation of the emergency rescue plan for production safety accidents of the unit;

 

 

 

  (6) Reporting production safety accidents in a timely and truthful manner.

 

 

 

  Article 18 The capital investment necessary for the production and business operation units to be possessed by the production and business operation shall be guaranteed by the decision-making body of the production and operation unit, the principal responsible person or the investor who is operated by the individual, and the capital investment necessary for the safe production shall be insufficient. The consequences are responsible.

 

 

 

  Article 19 The production, operation and storage units of mines, construction units and dangerous goods shall be provided with safety production management institutions or with full-time safety production management personnel.

 

 

 

  Other production and business units other than those specified in the preceding paragraph shall have a safety production management organization or a full-time safety production management personnel if the number of employees exceeds 300. If the employees are less than 300, they shall be equipped with full-time or part-time safety production management. Personnel, or entrust engineering and technical personnel with relevant professional and technical qualifications as prescribed by the state to provide safety production management services.

 

 

 

  The production and business operation unit entrusts engineering and technical personnel to provide safe production management services in accordance with the provisions of the preceding paragraph, and the responsibility for ensuring safe production is still the responsibility of the unit.

 

 

 

  Article 20 The main person in charge of the production and business operation unit and the safety production management personnel must have the safety production knowledge and management ability corresponding to the production and operation activities of the unit.

 

 

 

  The production, operation and storage units of dangerous goods, as well as the main person in charge of the mining and construction units and the safety production management personnel shall be qualified by the relevant competent department after passing the examination of their safety production knowledge and management capabilities. There is no charge for the assessment.

 

 

 

  Article 21 Production and business units shall conduct safety production education and training for employees, ensure that employees have the necessary safety production knowledge, be familiar with relevant safety production rules and regulations and safety operation procedures, and master the safe operation skills of this position. Those who are not qualified for safety production education and training may not be employed.

 

 

 

  Article 22 If a production and operation unit adopts new technology, new technology, new materials or uses new equipment, it must understand and master its safety technical characteristics, adopt effective safety protection measures, and conduct special safety production education and training for employees. .

 

 

 

  Article 23 Special operations personnel of production and business units must obtain special operation operation qualification certificates in accordance with relevant state regulations and obtain special operation operation qualification certificates before they can be employed.

 

 

 

  The scope of special operations personnel shall be determined by the department in charge of safety production supervision and administration of the State Council in conjunction with the relevant departments of the State Council.

 

 

 

  Article 24 The safety facilities of a new construction, reconstruction or expansion project of a production and operation unit (hereinafter collectively referred to as a construction project) must be designed, constructed and put into production and use at the same time as the main project. Investment in safety facilities should be included in the proposed project budget.

 

 

 

  Article 25 Mine construction projects and construction projects for the production and storage of dangerous goods shall conduct safety conditions demonstration and safety evaluation in accordance with relevant state regulations.

 

 

 

  Article 26 The designer and design unit of the safety facilities of the construction project shall be responsible for the design of the safety facilities.

 

 

 

  The design of safety facilities for mine construction projects and construction projects for the production and storage of dangerous goods shall be reported to the relevant departments for review in accordance with relevant state regulations, and the review department and its personnel responsible for review shall be responsible for the results of the review.

 

 

 

  Article 27 The construction unit of a mine construction project and a construction project for the production and storage of dangerous goods must be designed and constructed in accordance with the approved safety facilities and be responsible for the quality of the safety facilities.

 

 

 

  Before the mine construction project and the construction project for the production and storage of dangerous goods are completed and put into production or use, the safety facilities must be inspected and accepted in accordance with the relevant laws and administrative regulations; after acceptance, they can be put into production and use. The acceptance department and its inspection personnel are responsible for the acceptance results.

 

 

 

  Article 28 Production and business units shall set clear safety warning signs on production and operation places and related facilities and equipment with large risk factors.

 

 

 

  Article 29 The design, manufacture, installation, use, testing, maintenance, modification and scrapping of safety equipment shall conform to national standards or industry standards.

 

 

 

  The production and operation unit must carry out regular maintenance and maintenance of the safety equipment and regularly check it to ensure normal operation. Maintenance, maintenance, and testing shall be recorded and signed by the relevant personnel.

 

 

 

  Article 30 The special equipments used by production and business units that involve life safety and high risks, as well as the containers and means of transport of dangerous goods, must be produced by professional production units in accordance with relevant state regulations, and have obtained professional qualification testing. The inspection organization shall pass the inspection and inspection, and obtain the safety certificate or safety mark before it can be put into use. The inspection and inspection agency is responsible for the inspection and inspection results.

 

 

 

  The catalogue of special equipment involving life safety and high risk shall be formulated by the department in charge of special equipment safety supervision and administration of the State Council and shall be implemented after being approved by the State Council.

 

 

 

  Article 31 The State implements a phase-out system for processes and equipment that seriously endanger production safety.

 

 

 

  Production and business units shall not use processes and equipment that are obsolete or prohibited by the State and endanger the safety of production.

 

 

 

  Article 32 Where the production, operation, transportation, storage, use or disposal of dangerous goods are disposed of, the relevant competent department shall examine and approve and implement supervision and management in accordance with the provisions of relevant laws and regulations and national standards or industry standards.

 

 

 

  Production, business operations, production, operation, transportation, storage, use of dangerous goods or disposal of discarded dangerous goods must implement relevant laws, regulations and national standards or industry standards, establish a special safety management system, adopt reliable safety measures, and accept relevant competent authorities.   Article 33 A production and business operation shall register and file a major dangerous source, conduct regular inspection, evaluation and monitoring, and formulate an emergency plan to inform the employees and relevant personnel of the emergency measures that should be taken in an emergency.

 

 

 

  The production and business operation unit shall report the major dangerous sources of the unit, relevant safety measures and emergency measures to the relevant departments and relevant departments of the local people's government responsible for safety production supervision and administration in accordance with relevant state regulations.

 

 

 

  Article 34 The workshops, shops and warehouses for the production, operation, storage and use of dangerous goods shall not be in the same building as the staff quarters, and shall maintain a safe distance from the staff quarters.

 

 

 

  Production and business premises and staff quarters shall be provided with exits that meet the requirements for emergency evacuation, marked signs, and smooth flow. It is forbidden to close or block the export of production and business premises or staff quarters.

 

 

 

  Article 35 If a production and business operation conducts dangerous operations such as blasting or hoisting, special personnel shall be arranged to conduct on-site safety management to ensure compliance with operational procedures and implementation of safety measures.

 

 

 

  Article 36 A production and business operation shall educate and supervise the employees to strictly implement the safety production rules and regulations and safety operation procedures of the unit; and truthfully inform the employees of the risk factors, preventive measures and emergency measures for the workplace and work positions. .

 

 

 

  Article 37 Production and business units must provide labor protection articles for employees to meet national or industrial standards, and supervise and educate employees to wear and use according to the rules of use.

 

 

 

  Article 38 The production safety management personnel of a production and operation unit shall, in accordance with the production and operation characteristics of the unit, conduct regular inspections of the safety production status; the safety problems found during the inspection shall be dealt with immediately; if they cannot be handled, they shall be promptly reported. The responsible person of this unit. Inspection and handling should be recorded.

 

 

 

  Article 39 The production and business operation units shall arrange for the provision of labor protection articles and training for safety production.

 

 

 

  Article 40 If two or more production and operation units carry out production and business activities in the same operation area, which may endanger the production safety of the other party, they shall sign a safety production management agreement, clarify their respective safety production management duties and safety measures to be taken, and designate Full-time safety production management personnel conduct safety inspection and coordination.

 

 

 

  Article 41 A production and business operation unit shall not issue or lease production and business projects, places or equipment to units or individuals that do not have safe production conditions or corresponding qualifications.

 

 

 

  For production and operation projects, all the multiple contractors and renting units, the production and operation unit shall sign a special safety production management agreement with the contractor or the renting unit, or stipulate their respective safety production management duties in the contract and lease contract; The business unit shall coordinate and manage the safety production work of the contractor and the renter.

 

 

 

  Article 42 When a major production safety accident occurs in a production and business operation unit, the main person in charge of the unit shall immediately organize the rescue and shall not leave the company during the investigation and handling of the accident.

 

 

 

  Article 43 A production and business operation unit must participate in industrial injury insurance according to law and pay insurance premiums for employees.

 

 

 

  Chapter III Rights and Obligations of Practitioners

  Article 47 When an employee finds an emergency that directly endangers personal safety, he or she has the right to stop the operation or evacuate the workplace after taking possible emergency measures.

 

 

 

  The production and business operation unit shall not reduce the salary, welfare, etc. or cancel the labor contract with the employee due to the operation of the employee in the emergency case of the preceding paragraph or the emergency evacuation measures.

 

 

 

  Article 48 Any employee who has been harmed by a production safety accident shall, in addition to the social injury insurance in accordance with the law, obtain the right to compensation in accordance with the relevant civil laws, and shall have the right to claim compensation from the unit.

 

 

 

  Article 49 In the course of operation, employees shall strictly abide by the safety production rules and regulations and operating procedures of their own units, obey the management, and properly wear and use labor protection articles.

 

 

 

  Article 50 Employees shall accept safety production education and training, master the safety production knowledge required for their work, improve safety production skills, and enhance accident prevention and emergency response capabilities.

 

 

 

  Article 51 If an employee discovers a hidden danger or other unsafe factors, he shall immediately report it to the on-site safety production management personnel or the person in charge of the unit; the person receiving the report shall promptly handle it.

 

 

 

  Article 52 A trade union has the right to supervise and provide opinions on the simultaneous design, construction, and simultaneous production and use of the safety facilities of the construction project and the main project.

 

 

 

  The trade union has the right to demand corrections for violations of safety production laws and regulations and violations of the lawful rights and interests of employees, and finds that the production and business units have the right to propose solutions when they violate the regulations, force the risky operation or discover hidden dangers.   Chapter IV Supervision and Management of Safety Production

  (3) The hidden dangers discovered during the inspection shall be ordered to be immediately excluded; if the safety of major accidents cannot be guaranteed before or during the process of elimination, the operator shall be ordered to withdraw from the dangerous area and ordered to suspend production or stop using it; After the accident is removed, the production and operation can be resumed after examination and approval.

 

 

 

  (4) Sealing or seizing the facilities, equipment and equipment that are deemed to be inconsistent with the national standards or industry standards for ensuring safe production, and shall make a decision on handling within 15 days.

 

 

 

  Supervision and inspection shall not affect the normal production and operation activities of the unit under inspection.

 

 

 

  Article 57 The production and business operation units shall supervise and inspect the personnel responsible for the supervision and inspection of the departments responsible for safety production supervision and management (hereinafter collectively referred to as safety production supervision and inspection personnel), and shall cooperate with them and shall not refuse or obstruct them.

 

 

 

  Article 58 Safety production supervision and inspection personnel shall be devoted to their duties, adhere to principles, and enforce the law impartially.

 

 

 

  When the safety production supervision and inspection personnel perform the supervision and inspection tasks, they must present valid supervision and enforcement certificates; the technical secrets and business secrets of the units involved should be kept confidential.

 

 

 

  Article 59 The personnel of safety production supervision and inspection shall make a written record of the time, place, content, problems found and their handling, and shall be signed by the inspector and the person in charge of the unit under inspection; If the person refuses to sign, the inspector shall record the situation and report it to the department responsible for the safety production supervision and management.

 

 

 

  Article 60 The departments responsible for the supervision and management of production safety shall cooperate with each other in the supervision and inspection and conduct joint inspections; if they are required to conduct separate inspections, they shall communicate with each other and discover that existing safety problems shall be handled by other relevant departments.   Chapter V Emergency Rescue and Investigation and Handling of Production Safety Accidents

 

 

 

  Article 68 Local people's governments at or above the county level shall organize relevant departments to formulate emergency rescue plans for large-scale production safety accidents within their respective administrative areas, and establish an emergency rescue system.

 

 

 

  Article 69 The units of production, operation and storage of dangerous goods, as well as mines and construction units shall establish emergency rescue organizations; if the scale of production and operation is small, and emergency rescue organizations may not be established, part-time emergency rescue personnel shall be designated.

 

 

 

  The production, operation and storage units of dangerous goods, as well as mines and construction units shall be equipped with necessary emergency rescue equipment and equipment, and shall be regularly maintained and maintained to ensure normal operation.

 

 

 

  Article 70 After a production safety accident occurs in a production and business operation unit, the relevant personnel at the scene of the accident shall immediately report to the person in charge of the unit.

 

 

 

  After receiving the accident report, the person in charge of the unit shall promptly take effective measures to organize rescue, prevent accidents from expanding, reduce casualties and property losses, and immediately report the local departments responsible for safety production supervision and management in accordance with relevant state regulations, and may not conceal them.   Article 76 The departments responsible for the supervision and administration of production safety of the local people's governments at or above the county level shall regularly analyze the situation of production safety accidents within their respective administrative areas and make them known to the public on a regular basis.

 

 

 

  Chapter VI Legal Liability

 

 

 

  Article 77 If a staff member of a department that is responsible for the supervision and management of production safety has one of the following acts, it shall be given administrative sanctions for downgrading or dismissal; if a crime is constituted, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law:

 

 

 

  (1) Approving or accepting the matters involving safety production that do not meet the statutory safe production conditions;

 

 

 

  (2) discovering that units that have not obtained approval and acceptance according to law have engaged in relevant activities without authorization or have not been banned or not dealt with according to law after receiving the report;

 

 

 

  (3) Failing to perform supervision and management duties for units that have obtained approval according to law, and find that they no longer have safe production conditions without revoking the original approval or discovering illegal production violations.

 

 

 

  Article 78 If a department that is responsible for the supervision and management of production safety requires the unit that has been examined and accepted to purchase its designated safety equipment, equipment or other products, and collects fees for the examination and acceptance of safety production matters, The superior authority or the supervisory organ shall order the correction and order the refund of the collected fees; if the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law.

 

 

 

  Article 79 If an institution undertaking safety assessment, certification, testing, or inspection produces a false certificate and constitutes a crime, it shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law; if it is not criminally penalized, the illegal income shall be confiscated, and the illegal income shall be 5,000 yuan. If the above-mentioned fines are more than two times and less than five times the illegal income, if there is no illegal income or the illegal income is less than 5,000 yuan, a fine of 5,000 yuan or more and a fine of 20,000 yuan or more shall be directly responsible for the person directly responsible for it.   If there is an illegal act in the preceding paragraph that causes a production safety accident and constitutes a crime, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law; if it is not criminally penalized, the principal responsible person of the production and business unit shall be dismissed, and the investor of the individual shall be employed.   Article 81 If the main person in charge of a production and business operation fails to perform the duties of safety production management as stipulated in this Law, it shall be ordered to make corrections within a time limit; if it fails to make corrections within the time limit, the production and operation units shall be ordered to suspend production and suspend business for rectification.

 

 

 

  The main person in charge of the production and business unit has the illegal act of the preceding paragraph, which leads to a production safety accident. If it constitutes a crime, the criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law; if it is not enough for criminal punishment, the dismissal shall be imposed or the amount of 200,000 yuan or more shall be 200,000 yuan.   If the principal person in charge of a production or business unit is subject to criminal punishment or dismissal in accordance with the provisions of the preceding paragraph, it shall not be the principal person in charge of any production and business operation within five years from the date of execution of the penalty or the date of punishment.

 

 

 

  Article 82 If a production and business operation unit has one of the following acts, it shall be ordered to make corrections within a time limit; if it fails to make corrections within the time limit, it shall be ordered to suspend production and suspend business for rectification, and may impose a fine of not more than 20,000 yuan:

 

 

 

  (1) failing to establish a safety production management organization or equipped with safety production management personnel in accordance with regulations;

  (3) failing to conduct safety production education and training for employees in accordance with the provisions of Articles 21 and 22 of this Law, or failing to inform the relevant employees of safety production in accordance with the provisions of Article 36 of this Law. Matter

 

 

 

  (4) The special operation personnel have not received special safety operation training in accordance with the regulations and obtained the special operation operation qualification certificate, which is on the job.

 

 

 

  Article 83 If a production and business operation unit has one of the following acts, it shall be ordered to make corrections within a time limit; if it fails to make corrections within the time limit, it shall be ordered to stop construction or suspend production and suspend business for rectification, and may impose a fine of not more than 50,000 yuan; if it causes serious consequences, it constitutes a crime, Criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law:

 

 

 

  (1) The mine construction project or the construction project for the production and storage of dangerous goods has no safety facilities design or the safety facilities design has not been reported to the relevant departments for examination and approval according to the regulations;

 

 

 

  (2) The construction unit of the mine construction project or the construction project for the production and storage of dangerous goods is not designed and constructed in accordance with the approved safety facilities;

 

 

 

  (3) Before the completion of the mine construction project or the construction project for the production and storage of dangerous goods, the safety facilities have not been accepted and accepted;

 

 

 

  (4) failing to set obvious safety warning signs on production and operation places and related facilities and equipment with large risk factors;

 

 

 

  (5) The installation, use, testing, modification and scrapping of safety equipment do not conform to national standards or industry standards;

 

 

 

  (6) Failure to carry out regular maintenance, maintenance and regular inspection of safety equipment;

 

 

 

  (7) failing to provide labor protection articles for employees to meet national or industrial standards;

 

 

 

  (8) Containers and means of transport for special equipment and dangerous goods have not been tested and inspected by institutions that have obtained professional qualifications, and have obtained safety certificates or safety signs and put them into use;

 

 

 

  (9) The use of processes and equipment that are obsolete or prohibited by the State and endanger the safety of production.

 

 

 

  Article 84: Without the approval of the law, if the dangerous goods are produced, operated or stored without authorization, the law shall be ordered to stop the illegal act or be closed, the illegal income shall be confiscated, and the illegal income shall be more than 100,000 yuan, and the illegal income shall be more than doubled to five times or less. If there is no illegal income or the illegal income is less than 100,000 yuan, a fine of 20,000 yuan or more and 100,000 yuan or less shall be imposed.   (1) Producing, operating, storing, and using dangerous goods, failing to establish a special safety management system, failing to adopt reliable safety measures, or not accepting supervision and management implemented by relevant competent departments according to law;

 

 

 

  (2) failing to register or file a major hazard source, or failing to evaluate or monitor it, or failing to formulate an emergency plan;

 

 

 

  (3) Carrying out dangerous operations such as blasting and hoisting, and failing to arrange special management personnel to conduct on-site safety management.

 

 

 

  Article 86 If a production and business operation unit issues or leases production and operation projects, places and equipment to units or individuals that do not have safe production conditions or corresponding qualifications, it shall be ordered to make corrections within a time limit and confiscate the illegal gains; if the illegal income is more than 50,000 yuan, And impose a fine of more than one time but not more than five times the illegal income; if there is no illegal income or the illegal income is less than 50,000 yuan, a single or a fine of not less than 10,000 yuan but not more than 50,000 yuan; causing damage to others due to production safety accidents And the contractor and the lessee bear joint and several liability.

  Article 88 If a production and business operation unit has one of the following acts, it shall be ordered to make corrections within a time limit; if it fails to make corrections within the time limit, it shall be ordered to suspend production and suspend business for rectification; if it causes serious consequences and constitutes a crime, it shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law:

 

 

 

  (1) The workshops, shops, warehouses for the production, operation, storage and use of dangerous goods are in the same building as the staff quarters, or the distance from the staff quarters does not meet the safety requirements;

 

 

 

  (2) The production and business premises and staff quarters are not provided with exits that meet the requirements for emergency evacuation, marked signs, and remain unblocked, or closed or blocked production or business premises or employee dormitory exports.

 

 

 

  Article 89 If a production and business operation enters into an agreement with a practitioner to waive or mitigate its legal responsibility for the injury or death of the employee due to production safety accidents, the agreement is invalid; the main responsible person of the production and operation unit and the investment of personal business A fine of 20,000 yuan to 100,000 yuan is imposed.

 

 

 

  Article 90 If the employees of the production and business units disobey the management and violate the safety production rules and regulations or the operating procedures, the production and operation units shall give criticism and education, and shall be punished in accordance with the relevant rules and regulations; if a major accident is caused and constitutes a crime, it shall be related to the criminal law.   Article 91 If the principal person in charge of a production or business operation does not immediately organize a rescue in the event of a major production safety accident, or quits his duties or escapes during the investigation and handling of the accident, he shall be given a demotion or dismissal.   Article 92 Where the local people's government and the department responsible for the supervision and management of production safety conceal, report or delay the production safety accident, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law. Whoever constitutes a crime shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law.

 

 

 

  Article 93 A production and business operation entity does not have the safe production conditions stipulated in this Law and other relevant laws, administrative regulations, and national standards or industry standards. If it fails to meet the conditions for safe production after it has been suspended from production and is closed down, the relevant departments shall be legally closed. Revoke the relevant license.

 

 

 

  Article 94 The administrative penalties prescribed in this Law shall be determined by the department responsible for the supervision and administration of production safety; the administrative penalties for closure shall be reported by the department in charge of safety production supervision and management to the people's government at or above the county level in accordance with the authority prescribed by the State Council; The administrative punishment shall be determined by the public security organ in accordance with the provisions of the Regulations on Public Security Administration Punishment.   Article 95 If a production safety operation unit causes casualties or property losses caused by a production safety accident, it shall be liable for compensation according to law; if it refuses to undertake or its responsible person escapes, it shall be enforced by the people's court according to law.

 

 

 

  The person responsible for the production safety accident shall not be liable for compensation according to law. After the people's court has taken the implementation measures according to law, if the victim is still unable to provide full compensation to the victim, he shall continue to perform the compensation obligation; if the victim finds that the responsible person has other property, he may at any time.   Chapter VII Supplementary Provisions

 ItisunderstoodthatthetopofthehillgardenislocatedinthesouthsideofZhongshanCollege,DongchengDistrict,ZhongshanCity,ZhongshanCity,ontheeastsideofthesnowroad,willbebuiltintheStarCityBuilding. Thebuildingtobeexplodedis104.1meters,withatotalof34floors(including1basement),33.8meterswidefromeasttowest,38.5meterslongfromnorthtosouth,and27875squaremeters. Thebuildingisframe-supportedshearwallstructure,arrangedina“well”shape.The1stfloorandthebasementareframestructures,the2-32floorsareshearwallstructures,andthemiddlepartisthecoretube. Theeastsideofthebuildingis44metersawayfromthebottomoftheslope,thesoutheastsideis40metersawayfromDongyueTemple;thesouthsideis5.2metersawayfromthewall,only6metersawayfromthenearestresidentialhouse;thewestsideis81metersawayfromthebottomoftheslope. Thebuildingwasbuiltin1994andwascappedin1997. Forvariousreasons,thebuildinghasnotbeenofficiallyputintouse.IthasbeenrenamedasthePeakGarden,YangmingMountainVilla,StarCity,andZhongshanCity,butithasneverbeenabletogetridofthefateofthe"unfinished". InJune2007,thebuildingwastransferredtoZhongshanChangjiangZhaoyeRealEstateDevelopmentCo.,Ltd.asawhole. InordertocopewiththeoverallplanningdevelopmentofZhongshanCity,acceleratethepaceofrenovationoftheoldcity,andaccordingtothecompany'sprojectplanningneeds,decidedtouseblastingdemolition,theplotwillberebuiltafterthedemolition.
