今年以来,湖南、河北接连发生3起爆炸物品被盗案件,严重危害公共安全,社会影响恶劣。对此,公安部领导高度重视,先后作出批示指示,要求特别注意加强爆炸物品管控,追究企业主体责任,继续深化涉爆企业整治,狠抓主体、监管责任落实,加强检查督导,堵塞安全漏洞。近日,公安部专门下发通报,要求各地公安机关深入剖析案件暴露出的漏洞不足,研究采取切实有效办法措施狠抓安全管理责任落实,全面整治消除安全隐患,进一步加强和改进爆炸物品安全管理工作。

 

  一要强化督促检查,严格落实规章制度。要紧紧围绕最可能影响公共安全的爆炸物品运输、储存、使用环节,以人防、物防、技防、犬防等治安防范措施为重点,逐领域、逐部位、逐环节开展梳理检查,着重检查安全管理规章制度落实情况,发现隐患坚决督促整改,必要时依法责令停产停业整顿,决不放过任何问题和隐患。要针对目前矿产资源形势下滑的实际情况,对所有爆破作业单位进行一次全面排查,凡停产停业的,原则上一律清空库存爆炸物品;不能清空的,一律加派值守力量、落实治安防范措施,严防流散社会造成危害。对周边环境、总平面布置、安全设施和企业安全管理状况等发生重大变化的储存库,要督促爆破作业单位及时委托有资质的安全评价机构重新进行安全现状评价,对存在重大安全隐患未通过安全评价的储存库,要坚决予以停用。

 

  二要强化教育执法,严格落实主体责任。要切实强化对爆炸物品从业单位主要负责人及涉爆从业人员的安全法制教育,推动企业落实安全主体责任,从源头上加强安全监管,严防各类涉爆案件事故的发生。要坚持严格执法,对违法违规单位从严处罚,并将典型案例和对相关单位、人员的处罚情况在行业内进行广泛宣传,强化警示教育,切实形成震慑,让企业不敢违法、不愿违法。

 

  三要强化责任追究,严格落实监管责任。要严格落实爆炸物品安全监管责任制,将各项安全监管任务和责任分解到各级部门、落实到具体岗位、压实到基层一线,做到一级抓一级、层层抓落实。

 

  3起爆炸物品被盗案件查办处理情况

 

  1月4日12时许,湖南郴州资兴市公安局接到报警称,蓼江镇练图煤矿雷管库4400枚电雷管被盗。接报后,省、市、县三级公安机关立即组成专案组开展侦破工作,于1月8日抓获犯罪嫌疑人唐贵礼、唐敏华,追回被盗雷管。经审查,犯罪嫌疑人唐贵礼供述该矿老板拖欠其工资,多次索要未果,遂伙同另一犯罪嫌疑人唐敏华,于1月1日21时许潜入练图煤矿雷管库实施盗窃。经倒查剖析发现,练图煤矿安全管理主体责任不落实,治安防范措施形同虚设,值守人员长期脱岗,致使雷管库被盗3天后才发现报警;资兴市公安局矿管大队、蓼市派出所对练图煤矿民爆物品安全监管不到位,安全检查流于形式,未发现该矿保管员无资质的问题,对发现没有犬防措施等问题未督促整改到位。根据上述情况,资兴市公安局依法对练图煤矿处以20万元罚款,对法人唐国仁处以行政拘留,郴州市公安局依法吊销了练图煤矿的《爆破作业单位许可证》(非营业性);资兴市公安局对负有监管责任的矿管大队、蓼市派出所主要领导分别给予行政记过、行政警告等处分。

 

  1月15日5时许,承担山西江阳兴安民爆器材公司民爆物品运输任务的中国第一汽车集团公司清徐服务站晋A72635厢式货车行至107国道河北定州段与电厂桥交叉路口时,因雾大驾驶员李福生、杜美忠将车停靠在路边休息,导致车厢后门被撬,被盗336公斤炸药。经河北、山西公安机关全力侦破,于1月16日17时许抓获犯罪嫌疑人陈胜雪、刘光辉,追回被盗炸药。根据调查情况,定州市人民检察院依法对陈胜雪、刘光辉以涉嫌盗窃爆炸物罪批准逮捕;定州市公安局对李福生、杜美忠处以行政拘留,对未按照规定在炸药包装箱粘贴登记标识的山西江阳兴安民爆器材公司处以20万元罚款,对违反安全管理制度致使民爆物品被盗的中国第一汽车集团公司清徐服务站处以10万元罚款。

 

  2月7日3时许,湖南岳阳临湘市公安局接到报警称,桃林镇三星花炮厂用于生产烟花爆竹的750公斤军工硝被盗。经工作,专案组分别于2月8日、9日抓获盗窃军工硝的犯罪嫌疑人严桂芬、黎中华,该二人供述将盗得的军工硝销往桃林镇鸿运烟花爆竹厂。2月11日,非法购买军工硝的李红刚投案自首。经进一步调查发现,三星花炮厂涉嫌非法购买、储存爆炸物品,鸿运烟花爆竹厂涉嫌非法经营和生产、销售假冒伪劣产品。根据调查情况,临湘市公安局对严桂芬、黎中华、李红刚和三星花炮厂法人方立有、相关负责人柳星祥以及鸿运烟花爆竹厂法人汪培清、相关负责人骆先定等7人予以刑事拘留;湖南省公安厅已将案件情况通报省安监局,建议从严追究企业主体责任。
